Transliteration:( Innal lazeena ya'kuloona amwaalal yataamaa zulman innamaa ya'kuloona fee butoonihim Naaranw-wa sayaslawna sa'eeraa )
"Indeed, those who consume the property of orphans unjustly [30] are only filling their bellies with fire [31]. And they will soon be burned in the blazing fire."
From this we learn that if the orphan heir of the deceased is not present at the funeral, then no portion of his wealth must be spent on funeral rites or Fateha.
This is unlawful, because the orphan’s share is protected and cannot be used without rightful distribution.
The correct procedure is to distribute the wealth among the heirs according to Shariah.
After that, any adult heir may spend from their own share on funeral rituals.
⚠️ If this is not done, then whatever food the heirs eat from this wealth will be like eating the fire of Hell.
On the Day of Judgment, smoke will emanate from their mouths as a sign of this sin.
It is reported in a Hadith that whoever usurps the wealth of orphans unjustly:
Smoke will emerge from their mouths, ears, and noses,
Even from their graves on the Day of Judgment.
This will be the identifying mark of those who consumed orphan wealth unlawfully—
a clear warning and sign of disgrace and torment for such people in the Hereafter.
The tafsir of Surah Nisa verse 10 by Ibn Kathir is unavailable here.
Please refer to Surah Nisa ayat 7 which provides the complete commentary from verse 7 through 10.
(4:10) Behold, those who wrongfully devour the properties of orphans only fill their bellies with fire. Soon they will burn in the Blazing Flame.[14]
14. It is reported in a tradition that after the Battle of Uhud the wife of Sa’d b. Rabi’ brought her two daughters to the Prophet (peace be on him) and said: ‘O Messenger of God! These are daughters of Sa’d who was with you in the Battle of Uhud, where he was martyred. The girls’ uncles have seized the whole property and left nothing for them. Who will now marry these girls?’ It was after this incident that these verses were revealed.
