Transliteration:( Wa izaa hadaral qismata ulul qurbaa walyataamaa walmasaakeenu farzuqoohum minhu wa qooloo lahum qawlam ma'roofaa )
"And if the relatives, the orphans, and the needy [26] are present at the time of the division, then give them something [27] from it, and speak to them with kind words."
By "relatives, orphans, and the needy", the verse refers to those who are not entitled to inheritance, i.e., those deprived of a share due to legal heirs being closer in relation.
It is reported by Hazrat Muhammad bin Sireen (رضي الله عنه) that during the distribution of inheritance, his father slaughtered a sheep and invited poor relatives who had no legal share in the inheritance.
This act is based on compassion and social ethics, emphasizing that kindness should be extended to those excluded by law.
From this we learn:
If a grandson is deprived of inheritance due to the presence of an uncle (i.e., the father’s brother),
then the grandfather should make a will in the grandson's favour to ensure he receives something.
If the grandfather fails to do this, then the moral responsibility falls on the heirs—
They should voluntarily give a portion of their share to the grandchild.
⚠️ However, it must be remembered:
No portion should be taken from a minor heir, or from the share of an absent heir, for this purpose.
The act of giving should come only from adult heirs’ own shares, done willingly and consciously.
The tafsir of Surah Nisa verse 8 by Ibn Kathir is unavailable here.
Please refer to Surah Nisa ayat 7 which provides the complete commentary from verse 7 through 10.
(4:8) If other near of kin orphans and needy are pre sent at the time of division of inheritance give them some thing of it and speak to them kindly.[13]
13. This directive is addressed to the heirs of the deceased. They are told not to be niggardly towards their relatives whether they be close or distant. Nor should they be niggardly towards either poor and needy members of the family or towards orphans who are present when the inheritance is distributed. Although they are not legally entitled to any share it is seemly for people to act magnanimously and give them something out of their inheritance, and especially to desist from making hurtful remarks.
